Điều khoản miễn trừ trách nhiệm

1. Mục đích báo cáo

  • Các báo cáo và kết quả đánh giá ESG do VietESG công bố được thực hiện độc lập, dựa trên thông tin công khai từ doanh nghiệp và các nguồn dữ liệu hợp pháp.

  • Báo cáo chỉ nhằm cung cấp thông tin tham khảo cho nhà đầu tư, doanh nghiệp và các bên liên quan.

  • VietESG không đưa ra khuyến nghị mua, bán hoặc nắm giữ chứng khoán dưới bất kỳ hình thức nào.

2. Nguồn dữ liệu và giới hạn

  • Tất cả dữ liệu được trích dẫn từ báo cáo thường niên, báo cáo phát triển bền vững, báo cáo tài chính, hoặc các nguồn công khai chính thống khác.

  • VietESG không đảm bảo dữ liệu là tuyệt đối chính xác hoặc đầy đủ tại mọi thời điểm, do phụ thuộc vào mức độ công bố và minh bạch của doanh nghiệp.

  • Trường hợp dữ liệu không được công bố, VietESG ghi rõ “Chưa công bố/Không tìm thấy trong tài liệu”.

3. Giới hạn trách nhiệm

  • VietESG và các chuyên gia không chịu trách nhiệm đối với bất kỳ thiệt hại trực tiếp, gián tiếp hoặc hệ quả nào phát sinh từ việc sử dụng báo cáo hoặc dữ liệu ESG.

  • Mọi quyết định đầu tư, chiến lược kinh doanh hoặc hành động quản trị dựa trên báo cáo của VietESG hoàn toàn thuộc trách nhiệm của người sử dụng.

4. Quy trình cập nhật và khiếu nại

  • Doanh nghiệp được quyền phản hồi nếu phát hiện sai lệch dữ liệu; VietESG sẽ xem xét và điều chỉnh nếu có bằng chứng hợp lệ.

  • Việc cập nhật dữ liệu được ghi nhận công khai để đảm bảo minh bạch.

5. Quyền sở hữu trí tuệ

  • Bộ khung chỉ số ESG, trọng số và phương pháp đánh giá do VietESG xây dựng thuộc sở hữu trí tuệ của VietESG.

  • Việc sao chép, sử dụng hoặc phân phối phải được VietESG chấp thuận bằng văn bản.

  • If data are not available, VietESG clearly marks them as “Not disclosed/Not found in the documents.”

3. Limitation of Liability

  • VietESG and its experts shall not be held liable for any direct, indirect, or consequential losses arising from the use of ESG ratings, reports, or related data.

  • Any investment decisions, business strategies, or governance actions made based on VietESG reports remain the sole responsibility of the user.

4. Update and Appeal Mechanism

  • Companies have the right to respond if they identify inaccuracies in the data; VietESG will review and adjust upon valid evidence.

  • Any updates or corrections will be publicly recorded to ensure transparency.

5. Intellectual Property Rights

  • The ESG index framework, weighting system, and rating methodology developed by VietESG are the intellectual property of VietESG.

  • Any reproduction, usage, or distribution must be approved in writing by VietESG.
